鄞州一小区现奇葩现象:穿不同制服保安共管一个小区 小区门口站着两拨保安,分属两家不同物业公司   这段时间,鄞州区高桥镇罗曼风情小区大门口,进出的居民会发现门口站岗的保安人员比平时多了不少,有意思的是这些保安身穿两套不同的制服,靠近道闸的保安身穿深色上衣,外面的四五名保安则穿着白色衬衫,一问才得知原来这些保安分属两家不同的物业公司,是老物业和新物业掐上了。   记者 方磊 文 摄   [原来事出有因]   新物业已“入驻”,老物业却不愿撤出   日前,记者来到了小区了解情况。刚进小区大门,记者看见门口站了不少保安人员,负责指挥道闸的保安属于中澳物业,而靠近外面身穿白色上衣的是属于耐森物业,也就是老物业公司。两拨安保人员“严阵以待”,居民路过时都忍不住多看几眼。   记者上前询问了中澳物业的一名保安,他表示中澳物业公司已经入驻小区开展日常的服务工作了。对于这个说法,耐森物业的保安却认为小区还是属于耐森管理,物业并没有撤出。   进小区大门不远处,记者看见了好几处悬挂的大红色横幅,总体表达的意思大概就是“耐森物业请自重,走好不送”。   记者在现场也随机采访了几位居民,对于更换物业的事情,有支持的观点也有无所谓的态度。   “老物业太不地道了,服务那么差还不肯走。”   “换哪家物业公司都无所谓,只要能够提供良好的服务就行。”   “我觉得闹成这样没必要,到头来吃亏的还是我们居民,现在门口的几个道闸坏掉都没人管。”   ……   [业委会主任说]   老物业服务跟不上、财务审计也有问题   记者了解到,罗曼风情小区是2012年12月份交付的,一共有1076户居民,前期物业服务公司是耐森物业,那么为什么待了近4年的物业公司要被换掉,记者采访了小区的业委会主任周琼。   “业委会是2015年8月份正式成立的,我们的物业费不算低,高层是2.4元,小高层1.5元,别墅3元,公寓楼2.5元,大伙觉得这样的收费标准,物业公司却没有给出相对应的服务。”周琼举出一个例子,拿公寓楼来说,原先是24小时有人站岗值班,后来值班人员不知道什么原因就没有了。   此外,2015年12月,业委会向物业提出对过去三年的财务状况进行审计,发现了不少问题,“小区一共43部电梯,每年的费用是28万元,关于这笔钱的支出明细凭证,物业一直给不出。”周琼还表示,在业委会成立后,物业未经业委会同意、审核,自行签订了电梯维保合同,价格明显过高。   今年5月份业委会向耐森物业发了一份函,要求双方协商制定物业服务合同细则,周琼说没有得到回应。出于以上种种因素,业委会组织召开了业主代表大会,决议通过重新选聘物业,并在小区进行了公示。7月24日,业委会委托第三方招投标代理公司进行招标工作。8月初,业委会在小区通过现场、电话、短信等方式组织居民投票,900多户居民参与,并在小区内进行公开唱票,其间邀请居委会、镇政府等工作人员参与监督,结果中澳物业以514票胜出。   周琼告诉记者之后通过镇政府和鄞州区住建局的协调,双方定于9月9日进行正式交接,但就在交接当天上午遭到了老物业公司的阻挠。“中澳物业工作人员进不了场,耐森的保安站成一排拦在门口。”周琼回忆当天小区里突然增加了安保力量,很多人都是生面孔,有的人还在现场对业委会工作人员进行谩骂,直到当地警方介入,对方才散去。   [耐森物业回应]   业委会的做法不合法,已向法院起诉   随后记者采访了罗曼风情小区耐森物业的负责人王峥嵘,他认为业委会重新选聘物业没有得到业主授权,在程序上不合法,“没有召开过全体业主大会,业委会的做法需要通过第三方的裁决,在双方存在争议的情况下是不适合做交接的。”   提到9月9日当天发生的事情,王峥嵘告诉记者物业方是正常值班,人员上确实增加了安保力量,让他不能接受的是当晚物业的工作人员被部分业主强行赶出了小区,“即便要交接也不是这样操作的,移交工作涉及到设施设备的移交、物业人员安置、职权债务的切分等方面,不是说移交就移交的。”   而当天物业公司原本是同意和业委会进行交涉的,但由于前一天业委会在小区张贴公告,要求广大业主共同见证交接,这让物业方面不能接受,于是才有了堵门一幕。   王峥嵘表示如今为了避免冲突升级,物业方面已经将区域内的工作人员暂时撤出,只留下部分的保安进行管理。   此外,他还表示物业公司之前也对小区居民是否同意继续留用耐森物业做了一次摸底调查,“经过我们统计过半的业主是认可我们耐森物业的。”   王峥嵘也坦言并不能作为法律依据,“对于业委会的做法,我们已经向法院起诉,希望通过法律途径来判断究竟谁是谁非。”   [事件最新进展]   业委会收到了物业的起诉书,准备应诉   采访中无论是业委会主任周琼还是物业公司负责人王峥嵘,对于这次的事情他们都有一个共同的担心,那就是小区居民的人身安全无法得到保障。因为新老物业之争,使得小区的一些设施设备还未进行移交,特别是40多部电梯的日常维护,一下子成了无人管理的空白区域。   9月23日,记者再次联系业委会主任周琼,她表示业委会已经收到了物业的起诉书,准备应诉,而关于小区几十部电梯的日常维保,她告诉记者,目前小区在镇政府的协调帮助下已经更换了维保单位。   最后,记者采访了北京大成(宁波)律师事务所的刘海林律师,他表示根据国务院以及宁波关于物业管理条例的规定,业主委会应该通过业主大会决定续聘或选聘物业服务企业,“罗曼风情业委会确实在程序上存在一些瑕疵,但是否违规违法还得由法院最终裁决。”不过,刘律师认为,8月初业委会组织小区居民进行的选聘物业投票,已经表明绝大多数业主是同意进行重新选聘物业的,加上之前业委会的公告以及业主代表会议,他认为可以视作对前面未召开业主大会的补充。相关的主题文章:
